Please note, this Website is hosted in the United States and is intended for use by users who are United States residents.  All data collected from the Website is stored on servers within the United States that are owned and controlled by our third-party vendors or us.

Introduction to Privacy Policy

This Notice applies to information we collect on our Website, in email, other electronic messages between you and Monarch Diagnostics, information you provide to us, and information we collect when you use an online service through our Website, such as the “Supply Store” (i.e., https://monarchdx.com/my-account/).
This Notice does not apply to information collected by any third party, including through any application or content, including advertising, which may link to or be accessible from our Website, such as Events links. Monarch Diagnostics is not responsible for the privacy practices or the content of those other websites.
Please read this Notice carefully to understand our practices regarding your information and how we will treat it. This Notice may change from time to time (see Updates to this Privacy Notice) so please check the Notice periodically for updates. If there are any material changes to this Notice, we will notify you as required by applicable law.
This Notice does not apply to employment-related personal information collected from employees, job applicants, or similar individuals. Notice is provided to such individuals separately.
Where noted, this Notice does not apply to information relating to business-to-business communications (“B2B personal information”), for example, where a person is contacting us in their role as an employee, owner, director, officer, or contractor of a company.

Children Under the Age of 16

Our Website is not intended for children under the age of 16. We do not knowingly collect personal information from children under 16.  If you are under the age of 16, do not use or provide any information on our Website, including providing any information about yourself to us.  If we learn we have collected or received personal information from a child under the age of 16 without parental consent, we will delete that information.  If you believe we have any information from a child under the age of 16, please contact us see Help below).

Your Information and Collection methods

We collect information about you in many ways and some of the information we collect may include personal information that can be used to identify you. Personal information does not include publicly available information from government records or deidentified or aggregated information.

In the past twelve (12) months, we have collected the following categories of information:

(1) Identifiers and Personal Information (as defined in Cal. Civ. Code §1798.80(e)), such as your real name, any alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, bank account number, credit card number, debit card number, or any other financial information to process an individual’s request for an online course or material, or other similar identifiers;
(2) Commercial Information, such as products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;

(3) Internet or Similar Activity, such as your browsing history, search history, and information regarding your interaction with our Website or applications;

(4) Professional or Employment-Related Information, such as your current employer or job title, may be collected if voluntarily provided through certain forms on our website. If you choose to submit a resume or employment inquiry, we may collect additional information relevant to job applications. Resumes and related materials are accepted via email at hr@monarchdx.com, and any information submitted through that channel is handled in accordance with our data collection and retention practices;
(5) Inferences drawn from other personal information such as your profile reflecting your preferences.

We do not collect information relating to Protected Classification characteristics, Biometric Information, Precise Geolocation Data (however we do collect your address as an Identifier), Sensory Data, or Non-public Education Information.

Sources of Collected Data

Information you provide to us voluntarily.  In general, you can visit our Website without providing any information other than the information we collect automatically.  There are times, however, when we may need information from you.  You may choose to give us personal information in a variety of situations.  For example, we may collect your name, address, email address, telephone number, billing information, or other information you may provide when you contact us about our services, engage with our Website to register to use or use any of our services, when you submit a form, when you register for an event or for a course, when you request a paper or other information from us, or when you provide your contact information in your role as an employee when submitting applications for a Grant or Charitable Contribution.  If you contact us, we maintain records of your correspondence, including your name and address or email address.  

If you choose not to provide us with certain information, you may not be able to take advantage of certain features of our services.

Information we collect automatically.  As you navigate and interact with our Website, we may use automatic data collection technologies to collect certain information about you. For example, we use cookies to tell us about your device. Cookies are small pieces of information that are stored by your web browser on your computer’s hard drive and allow us to serve you faster and with better quality.  Cookies tell us about your equipment, browsing actions, and patterns including details of your visits to our Website, and information about your computer and internet connection, including your IP address or device identifier, operating system, and browser type.  

We may also use these technologies to collect information about your online activities over time.  This helps us to improve our Website and services and deliver a more personalized experience by, for example, storing information about your preferences, allowing us to customize our Website according to interests, and to improve content, speed up searches, recognize you when you return to our Website, and/or compile reports and analyze how well our websites and services are performing.

How you can control cookies.  You may refuse to accept browser cookies by activating the appropriate setting on your browser.  However, if you select this setting, this may prevent our websites or services from working properly.  

We also use the third-party marketing and analytics services provided by Google Analytics. These services use cookies with a randomly-generated ClientID in your browser. This ID is anonymized.  IP anonymization is also activated on our Website, which shortens your IP Address.  We send Google this shortened IP address to understand how visitors interact with our Website, what webpages are accessed, how often, and for which period of time our pages viewed.  This analysis is used to optimize our Website.  The IP address transferred through your browser to Google Analytics will not be combined with other data held by Google.  You can manage the data collected by Google Analytics by deleting your(_ga)cookies, installing the Google Analytics Opt-Out Browser Add-On, or by contacting us (see Help  below).

Our Website may contain links to other third-party websites, for example, when you access our Events link.  Some of these third parties may generate their own cookies. The third-party companies that generate these cookies may have their own policies and terms, including privacy policies. Monarch Diagnostics is not responsible for the privacy policies or practices of third-party websites.

Data Retention

We retain your personal information only as long as necessary to fulfill the purposes for which it was collected and to comply with our legal obligations. Our retention periods vary depending on the type of information and how it is used:

  • Account Information: Retained for the duration of your account plus 7 years after account closure for business and legal compliance purposes.
  • Transaction Records: Retained for 7 years after the transaction date for accounting and tax compliance.
  • Website Analytics Data: Retained for 26 months from the date of collection.
  • Marketing Communications: Retained until you unsubscribe or request deletion.
  • Customer Service Records: Retained for 3 years after the last interaction.
  • Job Applications: Retained for 2 years after the application process concludes.

When personal information is no longer needed, we securely delete or anonymize it. You may request deletion of your personal information at any time by contacting us (see Help section below), subject to our legal obligations to retain certain information.

Online Supply Store

Our website includes a Supply Store (i.e. https://monarchdx.com/my-account/), which is managed through WooCommerce and allows customers to purchase testing supplies and related products directly from Monarch Diagnostics. When you place an order, we collect necessary personal and payment information such as your name, shipping address, email, and payment details. Payments are processed securely through Square, a third-party payment processor. We do not store your full payment information on our servers. Please note that any personal information collected during your purchase is used solely to fulfill your order, provide customer service, and maintain transaction records in accordance with our data retention policies. Third-Party E-Commerce Vendor: Printful

Our website includes a “Shop” section that redirects visitors to an external online store operated by Printful, Inc., a third-party vendor that fulfills and ships branded merchandise on behalf of Monarch Diagnostics. When you visit or make a purchase through this store, you interact directly with Printful, and any personal information you provide — such as your name, shipping address, or payment details — is subject to Printful’s own privacy practices and terms of service. We do not store or control the information submitted on Printful’s platform. For more information on how your data is handled in that context, please refer to Printful’s Privacy Policy.

Summary of Third-Party Services

We work with several third-party service providers who may collect or process your personal information on our behalf:

  • Google Analytics: Collects website usage data and analytics. Data is anonymized and IP addresses are shortened. You can opt out using Google’s browser add-on or by managing cookies.
  • Square: Processes payments for our Supply Store. Square handles payment information according to their privacy policy and PCI DSS standards.
  • WooCommerce: Powers our Supply Store functionality and collects order and customer information.
  • Printful: Operates our external merchandise shop. Any information provided to Printful is subject to their privacy policy.

Each of these service providers is bound by contract to protect your information and use it only for the specified business purposes. We regularly review our third-party relationships to ensure they maintain appropriate data protection standards.

How Do We Use This Information

Monarch Diagnostics may use information that we collect about you or that you provide to us for the following purposes:

If you are submitting information on behalf of a third party,  Monarch Diagnostics expects that you have received appropriate consent, according to applicable privacy laws, before transferring any personal information to Monarch Diagnostics.

We may disclose aggregated information about users without restriction.  

Monarch Diagnostics may share your personal information with other parties in the following instances:

  • With Our Third-Party Service Providers. Monarch Diagnostics may share your information with our service providers who help us run our business and provide services on our behalf (for example, credit card processing services, managing our application process or providing marketing and analytical services). When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the service provider to keep the personal information confidential and not use it for any purpose except for performing the business purpose set forth in the contract.  
  • For Corporate Transactions. Monarch Diagnostics may also disclose your information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Monarch Diagnostics’ assets, where personal information held by Monarch Diagnostics about our Website users is among the assets transferred.
  • Other Reasons. To: (a) satisfy applicable law, regulations, legal process or valid governmental request; (b) enforce the terms of use applicable to our services, (c) detect, prevent or mitigate fraud or security or technical issues; or (d) protect against imminent harm to the rights, property or safety of our company, our customers or the public as required or permitted by law.

In the preceding twelve (12) months, Monarch Diagnostics has disclosed the following categories of personal information for a business purpose: (1) Identifiers, (2) Personal Information as defined in Cal. Civ. Code 1798.80(e), (4) Commercial Information, (6) Internet or other similar activity, and (11) Inferences drawn from personal information.  

In the preceding twelve months, Monarch Diagnostics has not sold personal information.  

Security

Monarch Diagnostics respects your personal information and takes steps to protect it from loss, misuse, or alteration.  Where appropriate, these steps can include technical measures like firewalls, intrusion detection and prevention systems, unique and complex passwords, and encryption.  We also use administrative and physical measures such as training staff on data processing obligations, identification of data incidents and risks, restricting staff access to your personal information, and ensuring physical security including appropriately securing information when not being used.

Updates to This Privacy Notice

Monarch Diagnostics may update this policy from time to time, without notice, and the updated version of this policy will be effective upon posting. Please check this page to review the most up-to-date version of this policy.  The date the privacy statement was last revised is identified at the top of the page. You are responsible for ensuring that we have an up-to-date active and deliverable email address for you, and for periodically visiting our website and the privacy statement to check for any changes. Continued use of our Website following the posting of changes constitutes acceptance of such changes. Where required by applicable data protection laws, we will also seek your consent to any material changes that affect how we use your information.

There is no fee for making a request, though we may charge a reasonable fee for excessive or repetitive requests.

Authorized Agents: You may designate an authorized agent to make privacy requests on your behalf. The agent must provide proof of authorization, and we may require you to verify your identity directly with us.

Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with additional rights regarding your personal information:

  • Right to Know: You can request information about the personal information we have collected, used, disclosed, or sold about you.
  • Right to Delete: You can request that we delete your personal information.
  • Right to Opt-Out: You can opt out of the sale of your personal information (note: we do not currently sell personal information).
  • Right to Non-Discrimination: We cannot discriminate against you for exercising your CCPA rights.

California “Shine the Light” Law: California residents may request information about our disclosure of personal information to third parties for direct marketing purposes. We do not currently share personal information with third parties for their direct marketing purposes.

Response Times: We will acknowledge your privacy request within 2 business days and provide a substantive response within 30 days. For complex requests, we may extend this period by an additional 30 days with notification.
